Terms of Use for Wishy

These Terms of Use ("Terms") govern your use of the Wishy app, website, and related services (collectively, the "Service"). The Service is provided by Artur Zavolovych ("Wishy," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission of a parent or legal guardian.

3. Your Account

You may sign in using supported authentication methods (for example Apple or Google). You are responsible for:

• Keeping account credentials and device access secure.
• Activities that occur under your account.
• Providing accurate profile information and keeping it reasonably up to date.

You agree not to share accounts or use another person's account without permission.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use on devices you own or control, in accordance with applicable platform rules.

You may not:

• Copy, modify, distribute, sell, rent, lease, or sublicense the Service.
• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
• Use the Service in a way that interferes with security, stability, or other users.

All rights not expressly granted are reserved by us.

5. User Content

You may submit content, including wishlist items, text, links, images, tags, profile content, and collaboration activity ("User Content").

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and process User Content solely to operate, improve, and provide the Service.

You are responsible for ensuring you have rights to the content you upload and share.

6. Acceptable Use

You agree not to:

• Post unlawful, infringing, defamatory, abusive, or deceptive content.
• Violate privacy rights or upload content you do not have permission to use.
• Harass, threaten, impersonate, or abuse other users.
• Attempt unauthorized access to accounts, systems, or data.
• Use bots, scraping, or automated methods to abuse the Service.

We may remove content, restrict features, suspend, or terminate accounts that violate these Terms.

7. Subscriptions and Billing

Wishy may offer optional paid subscriptions (for example Wishy Premium) that auto-renew.

• Billing: payment is charged to your Apple ID account at purchase confirmation.
• Auto-renewal: subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
• Renewal charge: your account may be charged within 24 hours before renewal.
• Management: you can manage or cancel subscriptions in your Apple account settings after purchase.
• Trials: if a free trial is offered, it converts to a paid subscription unless canceled before the trial ends.
• Refunds: Apple handles billing and refunds according to Apple's policies.
• Restore: you can restore previous purchases from within the app.

When Premium expires or is canceled

• Your existing content is not deleted solely because Premium ended.
• Wishes, tags, and other previously created data remain stored in your account unless you delete your account or specific content.
• Premium-tier allowances no longer apply; free-tier limits apply instead.
• Link import usage limits are enforced by plan tier.
• Link import usage counters are persisted at the account/profile level and are not reset solely because your subscription ended.
• Access to Premium-only collaborative list features may be removed while unsubscribed. Collaborative list data remains persisted.
• If you re-subscribe, access to your previously persisted Premium collaborative list data is restored.

Prices, available plans, and features may change from time to time where permitted by law and platform rules.

8. Third-Party Services and Links

The Service may integrate with third-party services (for example Apple, Google, Supabase, RevenueCat, PostHog, and Sentry) and may contain links to third-party websites. We are not responsible for third-party content, services, or policies.

9. Intellectual Property

The Service, including software, design, branding, graphics, text, and other materials (excluding your User Content), is owned by or licensed to us and protected by applicable intellectual property laws.

You may not use our trademarks, branding, or copyrighted materials without prior written permission.

10. Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Wishy and Artur Zavolovych will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business interruption, arising out of or related to your use of the Service.

Where liability cannot be excluded, our total liability is limited to the amount you paid (if any) for the Service in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Wishy and Artur Zavolovych from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service at any time and may delete your account in-app.

We may suspend or terminate access immediately if you violate these Terms, create risk for users, or where required by law.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute sections.

15. Governing Law and Disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules.

Any dispute arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Lviv, Ukraine, unless mandatory consumer protection law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Continued use of the Service after updated Terms become effective means you accept the changes.

17. Apple App Store Additional Terms

If you use the iOS app:

• These Terms are between you and Artur Zavolovych, not Apple.
• Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support.
• Apple is not responsible for claims relating to the app, including product liability, legal compliance, or consumer claims.
• In the event of any third-party claim that the app infringes intellectual property rights, Artur Zavolovych, not Apple, is responsible for investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
